<p><b>资本利得</b><b>(</b><b>亏损）</b></p>
<p> </p>
<p>      当资本资产出售时，买价与卖价之间的差额即是资本利得(亏损)。如果卖价高于买价，则有资本收益，如果卖价低于买价，则有资本亏损。</p>
<p>      资本利得(亏损)根据其持有的时间长短分为短期和长期。如果持有时间在一年以内，则作为短期。如果持有时间在一年以上，则作为长期。持有时间以所得资产的次日计算，直到出售资产的当日。</p>
<p> </p>
<p><b>资本利得税</b></p>
<p><br />      资本利得税适用于在美国的资本收益所得。一般而言，对于非居民外籍人士传统意义上的资本利得税的税率是30%或者美国与非居民外籍人士所在国所签订的更低的税务公约，但不适用于根据美国税法第871(d)条例所申明的房产的资本利得税。</p>
<p> </p>
<p><b>房产的资本利得税</b></p>
<p> </p>
<p>      如果出租房产有根据美国税法第871(d)条例作出申明，则此房产所产生的收入将视同于与美国有关联的贸易收入所得，进而能享受与美国居民同等的税率。 </p>
<p>根据持有时间的长短，如果是<b>短期持有</b>，即一年以内，则资本利得税等同于个人所得税的税率。如果是<b>长期持有</b>，即一年以上，则资本利得税为<b>15%</b></p>
<p>     值得一提的是，如果出租房产在出租期间有做折旧，当此房产卖出时，之前所做的折旧金额需要被收复，并课与25%的税率。</p>
<p> </p>
<p><b>房产的资本利得税预扣</b></p>
<p> </p>
<p>      根据1980年外籍人士房地产投资法案 (Foreign Investment in Real Property Tax Act of 1980, FIRPTA)，当非居民外籍人士出售美国房产时，需要预先扣留卖价的10%作为此房产的资本利得税的预扣。预扣由过户公司从卖价的款项中直接提交给美国 国税局。加州对资本利得要求预扣为3.33%, 所以外籍人士卖房后总共被预扣13.33%。</p>
<p>     </p>
<p>      如果房产卖价低于30万美金，并且买方购买后将作为自住屋，则无须预扣房产的资本利得税。此交易如果有资本利得，仍然需要申报及缴相应税。</p>
<p>     </p>
<p>       此预扣可以在非居民外籍人士申报其当年的个人所得税时作为税务预交款项。当非居民外籍人士当年的实际个人所得税低于所预扣之款项时，多预扣的款项是可以被退回的。如果年底非居民外籍人士没有申报个人所得税，则此款项将全额被美国国税局作为税款缴付。</p>

<p><b>资本利得税的申报</b></p>
<p> </p>
<p>      非居民外籍人士在申报其年度个人所得税时，如有资本利得税，需要额外填写附表D以申报。</p>
<p> </p>
<p> </p>
<p><b>1031</b><b>互换</b></p>
<p> </p>
<p>      当房产卖出后的一定期限内又购买了一“类似”的房产时，可以使用1031互换条例。但是需要注意的是，作为一个非居民外籍人士，当使用1031互换条例时，仍需要根据1980年外籍人士房地产投资法案做预扣。</p>
<p>1980年外籍人士房地产投资法案对于同步交换或者前制交换的房地产资本利得税预扣有着不同的要求。</p>
<p> </p>
<p>     在同步交换中，转让方在满足以下两点要求时无需做出预扣：</p>
<p>1．    转让方提供书面通知书给受让方，说明根据美国税法1031条例，转让方在此交换中没有承担任何的收益或者亏损。</p>
<p>2．    在转让发生的第20天，受让方给美国国税局提供一份转让方所写的书面通知书</p>

<p>外籍人士是指非美国公民或美国国籍人士。非居民外籍人士是指没有绿卡或不符合长期居住条例的外籍人士。</p>
<p> </p>
<p>一般而言，如果满足以下情况，非居民外籍人士需要申报美国税表：</p>
<p>1．    非居民外籍人士在美国想或从事贸易</p>
<p>2．    非居民外籍人士没有在美国从事贸易，但是拥有美国收入，且税务预扣无法满足当年所需缴纳税款</p>
<p>3．    上述1，2项所提及非居民外籍人士的代表人</p>
<p>4．    非居民外籍人士的遗产或信托受托人</p>
<p>5．    代理非居民外籍人士的个人及财产的美国居民或当地受托人</p>
<p> </p>
<p>非居民外籍人士所需申报的美国税务可以分为以下两大类：</p>
<p>1．    与美国有关联的贸易收入所得</p>
<p>2．    固定的，预知的，年度的，或者周期性的美国收入</p>
<p> </p>
<p><b>对于出租房产所得而引起的税务</b></p>
<p> </p>
<p>如果非居民外籍人士在美国拥有因房产而产生的收入，可以根据美国税法第871(d)条例，将由房产产生的收入作为与美国有关联的贸易收入所得。此类收入包括租金收入以及矿产，石油，天然气，或其他自然资源的使用费。同时，房产的出售或交换也包括在内。</p>
<p> </p>
<p>如果作出此选择，房产相关的开销可以相应抵扣，只有净收入才需要被征收税。此选择可以根据美国税法第871(d)条例在申报个人所得税是提交一份相应的申明给美国国税局。</p>
<p> </p>
<p><b>税率</b></p>
<p> </p>
<p>以下是2011年联邦个人所得税率，以单身为例：</p>
<p> </p>
<p>10%              $0 - $8,500</p>
<p>15%              $8,500 - $34,500</p>
<p>25%              $34,500 - $83,600</p>
<p>28%              $83,600 - $174,400</p>
<p>33%              $174,400 - $379,150</p>
<p>35%              $379,150 +</p>
<p> </p>
<p>因此，当非居民外籍人士在美国投资购买房地产并出租时，便有了需要向美国政府申报其个人所得税的义务。</p>
<p> </p>
<p>假设一栋价值50万美金的房产，一年的租金收入有3万6千美金，扣除物业费，房地产税，基本维修，水电费，及折旧共2万美金，则此出租房产净收入为1万6千美金，以2011年单身税率需缴纳1975美元的联邦个人所得税。</p>
<p> </p>
<p>同时，出租房产所得的净收入也需要向所在州申报个人所得税。不同州的州税也不同。因此，在通常情况下，如果非居民外籍人士在美国拥有出租房产收 入的时候，每一年度，需要申报两份税表，一份给联邦申报联邦个人所得税，一份给房产所在州申报州个人所得税。个人所得税的截止日为4月15日，申报上一年 度一月至十二月的个人所得。</p>
<p> </p>
<p><b>入不敷出亦要报税</b></p>
<p> </p>
<p>有时候当房产无法顺利出租或因其他原因而入不敷出时，即使个人所得税为零，仍然需要作出申报。</p>
<p> </p>
<p>假设一年的租金收入有1万2千美金，扣除物业费，房地产税，基本维修，水电费，及折旧共2万美金，则此出租房产净亏损为8千美金。不要以为出租 房产处于亏损状态无需缴纳个人所得税就不需要申报。这种想法是不正确的。因为如果你不做申报，美国国税局会根据此房产的租金收入1万2千美金计算个人所得 税。使得原本因亏损无需缴纳个人所得税的年度而收到美国国税局的税务单。</p>
